Consumer Sales Terms (B2C)
Current website status: Minibike Friends is currently a product-preview and non-binding dealer Early Access platform. Online purchases and payments are not available. Submitting an enquiry or survey does not place an order or create a purchase contract. Provisions concerning purchases apply only where a purchase contract is actually concluded.
1. Scope
These general terms apply to contracts for the purchase of goods concluded through Minibike Friends between consumers and EXPAQ GmbH.

A consumer is a natural person entering into a legal transaction predominantly for purposes outside their trade, business or independent professional activity. Separate business or dealer terms may apply to customers acting as businesses.
2. The role of Minibike Friends
Minibike Friends operates the technical distribution and intermediary platform on which products are presented and orders transmitted. It is not the seller and does not become a party to the purchase contract, which is concluded exclusively between the customer and EXPAQ GmbH. Minibike Friends may support product presentation, technical order processing, customer communication and forwarding enquiries without becoming the seller.
3. Contract language
The language available for concluding the contract is German. This English translation does not change the stated contract language.
4. Product presentation and contract formation
Product presentation is not a legally binding offer to conclude a purchase contract; it is an invitation to place an order. Where ordering is enabled, customers may add products to their cart without obligation and correct their details using the facilities provided before placing a binding order.
By clicking the button “zahlungspflichtig bestellen” (“order with an obligation to pay”), the customer makes a binding offer to EXPAQ GmbH to purchase the goods in the cart. An electronic acknowledgement of receipt is sent without undue delay. This automatic acknowledgement is not acceptance unless it expressly states otherwise. The contract is formed when EXPAQ GmbH accepts through an explicit order confirmation, a dispatch confirmation or dispatch of the goods.
5. Storage of the contract
Order details and applicable terms are stored within legal and technical capabilities. A confirmation is sent to the customer’s email address after the order is submitted. The applicable terms can be accessed and saved from the website before ordering.
6. Prices
Consumer prices are total prices including applicable statutory VAT. Additional delivery and shipping charges are shown separately with the product or, at the latest, during checkout before ordering. The total price displayed at the time of ordering applies.
7. Payment
Available payment methods are displayed during checkout and may include PayPal, credit card or bank transfer, depending on availability. EXPAQ GmbH, as seller, is entitled to payment under the purchase contract. External payment providers’ terms may also apply.
8. Delivery
Goods are delivered to the address provided during checkout. Delivery times are stated with the product or in checkout; different times for particular products are expressly indicated. If ordered goods are exceptionally unavailable, the customer is informed without undue delay. Payments already received for goods that cannot be supplied are refunded without undue delay.
9. Partial deliveries
Partial deliveries are permitted where reasonable for the customer. A partial delivery initiated by EXPAQ GmbH does not result in additional shipping charges unless expressly agreed otherwise.
10. Transfer of risk
For consumers, the risk of accidental loss or deterioration generally passes only upon delivery to the customer or a third party designated by them. This does not apply if the customer independently commissions a carrier not previously nominated by EXPAQ GmbH.
11. Retention of title
Goods remain the property of EXPAQ GmbH until the purchase price is paid in full.
12. Statutory rights in respect of defects
Consumers have the statutory rights in respect of defective goods. These include a right to subsequent performance and, subject to statutory conditions, a price reduction, termination of the contract and, where applicable, damages. Any additional commercial or manufacturer’s guarantee applies only where expressly stated for the product; statutory rights remain unaffected.
13. Product information and vehicle compatibility
Information on models, dimensions, compatibility, materials, technical characteristics and uses is based on the available manufacturer, supplier or product information. Before installation or use, customers should check suitability for the specific vehicle, variant and intended use. Any specific installation, assembly, safety or use instructions must be observed.
14. Road approval and use of vehicle parts
Vehicle, tuning and performance parts may be subject to registration, general operating permit (ABE), type approval, E-marking or other approval requirements. Relevant approvals are stated in the individual product offer. Parts expressly marked as not approved for public roads or as motorsport, racing or show parts may only be used on public roads where the applicable legal requirements are satisfied. Statutory requirements for vehicle modifications remain unaffected.
15. Product safety
Specific safety, installation and warning instructions may apply. Before installation and use, customers must observe the manufacturer, safety, assembly and use instructions supplied with the goods or on the product page. Required product and manufacturer information is provided in the product offer where applicable.
16. Liability
EXPAQ GmbH is liable without limitation for loss caused intentionally or by gross negligence and for culpably caused death or personal injury, including injury to health. For a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable loss typical of the contract. Material obligations are those whose performance makes proper execution of the contract possible and on which customers may ordinarily rely. These limitations do not restrict mandatory statutory liability, particularly product liability.
17. Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. Conditions, deadlines and consequences are explained in the separate Withdrawal Policy, which includes the model withdrawal form. An electronic withdrawal function is also provided where legally required.
18. Returns following withdrawal
Goods must be returned to the address specified in the Withdrawal Policy in accordance with that policy. Consumers bear the direct return costs if properly informed of this and unless EXPAQ GmbH expressly agrees to bear them.
19. Refunds
Following a valid withdrawal, refunds are made in accordance with the law. The original payment method is generally used unless expressly agreed otherwise without cost to the customer. For consumer goods sales, reimbursement may be withheld until the goods are received back or evidence of return is supplied, whichever occurs first.

Minibike Friends may receive enquiries and forward them to EXPAQ GmbH. EXPAQ GmbH remains the contractual contact for claims arising from the purchase.
21. Dispute resolution
Information on whether EXPAQ GmbH participates in, or is obliged to participate in, proceedings before a consumer arbitration body is provided separately where required by law.
22. Applicable law
German law applies. For consumers, this choice applies only insofar as it does not deprive them of protection afforded by mandatory provisions of the country of their habitual residence.
23. Final provisions
If a provision is or becomes wholly or partly invalid, the remaining statutory provisions remain unaffected.
