Platform Terms of Use

Current website status: Minibike Friends is currently a product-preview and non-binding dealer Early Access platform. Online purchases and payments are not available. Submitting an enquiry or survey does not place an order or create a purchase contract. Provisions concerning purchases apply only where a purchase contract is actually concluded.

1. Scope

These terms govern use of the Minibike Friends platform. The platform operator is:

Depending on the area concerned, the platform may be used by consumers within section 13 BGB and businesses within section 14 BGB.

2. Purpose of the platform

Minibike Friends provides digital infrastructure for presenting, marketing and intermediating product offers. Registration, dealer approval, product information, communication and order-forwarding functions may also be provided.

3. The role of Minibike Friends

Unless expressly stated otherwise in an individual offer, Minibike Friends is not the seller of goods offered through the platform. A purchase contract is concluded exclusively between the customer and the seller identified in the offer. Providing the platform, presenting products, technically facilitating the ordering process and forwarding orders do not create a purchase contract between Minibike Friends and the customer.

5. Registration and user accounts

Minibike Friends may make certain functions conditional on prior registration. Users must provide complete, truthful and up-to-date information and protect their credentials from unauthorised third-party access.

6. Dealer areas

Certain content, prices, terms or ordering facilities may be restricted to businesses. Minibike Friends may request appropriate information or evidence of business status. There is no entitlement to approval of a dealer account.

7. Product information

Descriptions, technical data, compatibility details and other product information are published using information from the seller, manufacturer, importer or other authorised sources. The relevant offer and the purchase contract with the seller determine the agreed characteristics and scope of delivery.

8. Permitted use

The platform may only be used through its intended functions. Abusive access, attempted manipulation, bypassing technical safeguards, unauthorised use of another person’s credentials and automated access outside expressly provided interfaces are prohibited.

9. Availability

Minibike Friends endeavours to keep the platform available with as few interruptions as possible. Uninterrupted or fault-free availability at all times is not guaranteed. Maintenance, technical faults, security measures and circumstances beyond our control may cause temporary restrictions.

10. Intellectual property

Content including text, photographs, product images, graphics, logos, designs and databases may be protected by copyright, trade mark or other intellectual property rights. Use beyond the intended use of the platform requires the relevant rights holder’s permission.

11. Suspension and closure of accounts

Minibike Friends may temporarily suspend or permanently close accounts, particularly in cases of serious breaches of these terms, false or misleading information, security risks or misuse. Where appropriate in the circumstances, the user will first be given an opportunity to respond or remedy the issue.

12. Liability of Minibike Friends

Minibike Friends is liable without limitation for loss caused intentionally or by gross negligence, and for culpably caused death or personal injury, including injury to health.

For a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable loss typical of the contract. Mandatory statutory liability remains unaffected. Obligations arising from a purchase contract concluded through the platform are the relevant seller’s responsibility under the applicable law and contract.

13. Applicable law

For consumers, German law applies without depriving them of mandatory consumer protection in their country of habitual residence. For businesses, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. To the extent legally permitted, the courts at the place of business of Minibike Friends have jurisdiction where the user is a merchant, a legal person under public law or a special fund under public law.
